Applying for indefinite leave to remain (ILR) in the UK

Indefinite leave to remain (ILR) is one of the most significant stages of the UK immigration journey. It grants permanent residence — the right to live and work in the UK without any time restriction. But it also has one of the most demanding document requirements of any UK visa route.

A successful ILR application requires evidence across multiple categories: identity, immigration history, qualifying period, absences, English language, knowledge of life in the UK, and route-specific criteria. This guide covers what you need.


The qualifying period

The standard qualifying period for most routes is 5 years of continuous lawful residence. Some routes have shorter qualifying periods:

  • Skilled Worker (previously Tier 2): 5 years
  • Spouse / Partner (Appendix FM): 5 years (2 years on pre-April 2024 rules in some cases)
  • Long Residence: 10 years continuous lawful residence
  • Innovator Founder / Start-up: 3 years (Innovator Founder route)

You must calculate your qualifying period carefully. Certain absences outside the UK can reset or interrupt the continuous residence requirement.


Core documents required for all ILR applications

Identity documents

  • Valid current passport
  • All passports held during the qualifying period — UKVI will check departure and entry stamps
  • Biometric residence permit (BRP) if held

Immigration status documents

  • All previous visas, entry clearance vignettes, and leave to remain stamps
  • Any UKVI decision letters from previous applications
  • Evidence of continuous lawful leave throughout the qualifying period (no gaps, no overstays)

Absences from the UK

  • You must not have exceeded the absences limit for your route during the qualifying period
  • Most routes: maximum 180 days in any 12-month period (check your specific route)
  • Prepare a complete absences table: destination, departure date, return date, reason for travel
  • Supporting evidence: flight tickets, boarding passes, hotel bookings

English language evidence

For most routes, you need English language evidence at B1 level or above:

  • SELT test certificate from an approved provider
  • UK degree at bachelor's level or above
  • Degree from a majority English-speaking country (as defined by the Home Office)
  • If you passed an English language test for a previous visa application, you may be able to rely on it — check the specific rules for your route

Life in the UK test

A Life in the UK test pass certificate is required for all standard ILR applications unless you are:

  • Under 18 years of age
  • Aged 65 or over
  • Have a long-term physical or mental condition that prevents you from meeting the requirement

Keep your original pass certificate. UKVI may ask to see it even if you passed several years ago.


Route-specific documents

Skilled Worker (former Tier 2 General)

  • Letter from employer confirming: job title, start date, salary, and that you will continue in the role (for further leave), or confirmation that employment covered the qualifying period
  • Payslips for the last 12 months (or covering the entire qualifying period)
  • P60 for the most recent complete tax year
  • Bank statements confirming salary payments

Spouse / Partner (Appendix FM)

  • Evidence of the relationship throughout the qualifying period
  • Financial evidence meeting the income threshold for the year of application
  • Accommodation evidence

Long Residence (10-year route)

  • Evidence of lawful leave throughout the entire 10-year period — this is the hardest category to document
  • Any gaps in leave, even of one day, can be fatal to the application
  • Evidence of continuous UK residence: utility bills, bank statements, GP registration, school records

Financial evidence

ILR applications do not have a blanket financial requirement in the same way as entry clearance applications — but route-specific rules may apply. For Skilled Worker ILR, you generally do not need to show minimum savings unless you are near the threshold.

However, you should provide:

  • 12 months of bank statements showing regular income
  • Evidence of no recourse to public funds conditions being met (if applicable to your route)

Photographs

  • 2 recent passport-sized photographs meeting UKVI specifications
  • White background, no glasses, neutral expression

Common ILR refusal reasons

  1. Absences exceeding the 180-day limit — even a few days over can cause refusal. Count every trip carefully.
  2. Gap in continuous leave — a single day where leave expired before a new grant is a serious issue. Check all visa dates.
  3. Missing passports — if you cannot produce a previous passport, you need to explain why convincingly.
  4. Employer letter that is too generic — must confirm the qualifying period specifically.
  5. Life in the UK test certificate not matching personal details — name, date of birth must match your passport exactly.
  6. Out-of-date evidence — financial and relationship evidence must be recent, typically within 28 days of the application date.
